Further to my original representation, I have had further correspondence which should be taken into consideration for this review of the premises licence application for The Museum Gardens, York.
In my representation I mentioned that the noise limits had been exceeded by 3dB on only one occasion and then reduced back down again. This did occur but only on the day of the sound propagation tests. These tests are essential to understand the sound climate at a venue before the event begins and do not form part of the assessment of the event itself and should be discarded from consideration.
Secondly, I proposed a possible condition in relation to installing a noise limiting device at the venue and have since received valid explanations as to why this would be extremely challenging at the site. I would therefore recommend that this proposed condition is removed from consideration.
